This Policy covers Landlord Exit Options, its property-information form, and related calls, texts, emails, and transaction communications. It does not cover a title company, attorney, independent buyer, real-estate professional, contractor, or other third party that handles information under its own privacy policy.
We serve rental-property owners throughout the United States. Information may be processed and stored in the United States, and privacy rights can vary by state.
2. Information we collect
Information you provide
When you submit a property or communicate with us, we may collect:
- Contact information: your name, email address, phone number, and communication preferences.
- Property information: address, property type, occupancy, listing status, condition, desired timing, ownership duration, asking price, and reason for considering a sale.
- Authority information: whether you own the property or are authorized to act for an owner, trust, estate, or entity.
- Rental and transaction information: leases, rent records, deposits, arrears, notices, repairs, photos, title or loan information, and other details you choose to provide.
- Communications: messages, call notes, documents, requests, feedback, and records of consent or opt-out choices.
Please do not send Social Security numbers, bank credentials, alarm or lockbox codes, or other highly sensitive information through the general property form.
Information collected automatically
Hosting, security, and similar service providers may automatically receive IP address, browser and device type, timestamps, requested pages, referring page, approximate location derived from IP, and diagnostic or fraud-prevention data. If we use analytics or similar tools, they may collect information about how visitors use the site.
To limit repeated or abusive form submissions, the website may convert an IP address into a short-lived one-way rate-limit identifier. That identifier is not included in the lead spreadsheet.
Information from other sources
We may review public property, tax, court, permit, business, title, or listing records; information from transaction and service providers; and information supplied by other people involved in the property. We may combine that information with what you provide.
3. How we use information
We may use information to:
- respond to your request and communicate about the property;
- confirm ownership, authority, occupancy, lease status, condition, title, and other transaction facts;
- evaluate whether Onyx or another prospective buyer may be interested;
- prepare, discuss, negotiate, administer, assign where permitted, or close a possible transaction;
- coordinate due diligence, inspections, title work, settlement, and related services;
- operate, secure, troubleshoot, measure, and improve the website and inquiry process;
- prevent fraud, abuse, duplicate requests, and security incidents;
- maintain business records, honor communication preferences, and comply with law; and
- send follow-up or marketing communications when permitted.
Submitting property information does not require you to sell and does not create a purchase agreement.
4. How form information is stored
Information submitted through the property form is first stored in an access-restricted website database used for lead review, delivery reliability, and follow-up. Selected property and contact fields may also be copied to an access-restricted Google Sheet within Google Workspace. Google may process that copy as our service provider under its applicable terms and safeguards. Authorized Onyx personnel and service providers may access these systems when they need the information for the purposes described in this Policy.
Our website host, security providers, communications providers, and other business systems may also process limited information needed to deliver, protect, or respond to a request.
5. How information may be disclosed
We may disclose information to these categories of recipients:
- Service providers and advisers: website hosting, security, form processing, Google Workspace, communications, customer-management, valuation, due-diligence, title, escrow, closing, legal, accounting, and similar providers working for us.
- Prospective or actual transaction participants: Onyx affiliates, funding sources, assignees, independent buyers, agents, contractors, inspectors, title companies, settlement providers, attorneys, and others evaluating or completing a possible transaction.
- Authorities or affected parties: when reasonably necessary to comply with law or legal process, protect rights or safety, investigate fraud, or enforce an agreement.
- Business transaction recipients: a buyer, successor, lender, or adviser involved in a merger, financing, sale, reorganization, or transfer of some or all of our business or assets.
- Recipients you direct: when you ask us to share information or otherwise consent.
A property opportunity may be evaluated by or presented to another buyer, including in connection with an assignment or transfer of contractual rights where lawful. Some state privacy laws define “sale” or “sharing” broadly and may give eligible residents rights concerning certain disclosures, even when the disclosure is part of evaluating a transaction. We honor applicable notice and choice requirements.
We do not publish your property-form responses or tenant information on this website.
7. Retention and security
We retain information for as long as reasonably necessary to respond to an inquiry, evaluate or complete a possible transaction, maintain records, honor opt-outs, resolve disputes, prevent fraud, and meet legal obligations. The period can vary based on the type of record and whether a transaction occurs.
We use reasonable administrative, technical, and organizational safeguards appropriate to the information. No method of internet transmission or electronic storage is completely secure, so we cannot guarantee absolute security.
8. Your choices and privacy rights
You may choose not to provide information, although we may then be unable to evaluate the property. You may ask us to stop marketing communications, correct inaccurate contact information, or close out an inquiry.
Depending on your state and whether the relevant law applies, you may have rights to know, access, correct, delete, or obtain a copy of personal information; opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses of sensitive information; and appeal a denied request. We will not unlawfully discriminate against you for exercising a privacy right.
We may need to verify your identity, property connection, and authority before completing a request. An authorized agent may be asked to provide proof of authorization. To make a privacy request, use the contact information in Section 12.
9. Calls, texts, and email
If you provide contact information and submit the form, we may contact you about the property using the methods and consent described beside the submit button. That consent does not require you to accept an offer or sell the property. Message and data rates may apply.
You may ask us not to make marketing calls, reply STOP to marketing text messages, or use an unsubscribe method included in a marketing email. We may retain consent and opt-out records so that we can document and honor your choices. Communications needed to respond to an active request or complete a transaction may continue where permitted.
10. Children’s privacy
Landlord Exit Options is intended for adults considering a property transaction and is not directed to children under 13. We do not knowingly collect personal information from children through the property form. Please contact us if you believe a child submitted information.
11. Changes to this Policy
We may update this Policy as our services, providers, or legal obligations change. We will post the revised version and change the effective date. If required, we will provide additional notice or choice for a material change affecting previously collected information.
